Online Digital Marketing Courses

To register for a Course at Way WeDesign, you should be at least 18 years of age.
A student’s registration and enrolment for courses are a binding agreement to finish the course and to pay the full fees. The application form must be signed to show the student’s agreement to follow Way WeDesign’s terms and conditions.

Fees

Online Advertising and Marketing Services:

The Client agrees to pay Way WeDesign compensation for the Services agreed upon between the Client and the Company as set out in this agreement and defined in the contract as applicable. Payments shall be made before services are rendered by the Company. Invoices are delivered at the 30th day of each month. Payment by cheque or credit card is due by the last day of the month. Marketing and advertising programs may be paused if payment has not been made by payment due date; re-initiation fees may apply.

Online Digital Marketing Courses:

All fees are payable INR and payment can be made as follows:
By bank transfer directly to our account. Please note that all bank charges must be paid at source, otherwise the student will be charged on arrival. Please email or fax us a copy of the remittance advice. Please indicate the student’s name on the remittance.
By cheque made out to “Way WeDesign Pvt. Ltd”

Cancellations & Refunds

Online Advertising and Marketing Services:

Contract may be cancelled by either parties with one-month prior notice, in any instance the client withdraws the service without prior notice, he is bound to pay one month’s service fees or with mutual consent on such terms as may be agreed upon by the parties.
However, the contract may be renewed as per the mutual understanding between the parties that may be endorsed in writing and shall form part of the original contract
The fees you pay for registration or towards any other cause during the course will be non-refundable.

Online Digital Marketing Courses:

If, after payment, Way WeDesign is unable to provide you a place in our course, a full refund will be ensured.
Refunds will not be given in case you miss a lesson for any reason and neither will you be allowed to take the missed lesson again.
Students will only receive an end-of-course certificate if their attendance is 70% or more.
Way WeDesign may terminate your course in the case of serious misconduct and no fees will be refunded. So, you are expected to behave in a suitable way both inside and outside the classroom.

Way WeDesign offers a variety of services to improve a website’s online visibility. By engaging us, you agree to the Terms of Service set forth below. If you have questions, or if we may be of any service, please do not hesitate to contact us. Way WeDesign provides search engine marketing, optimization and associated services on a local, national and international basis. As such, we submit information on your behalf to search providers for whom you must agree to their terms and conditions. These providers may include, but are not limited to: Google, Yahoo, MSN/Bing, local online newspapers, Facebook, YouTube and other sites. The terms and conditions of these providers all apply. Way WeDesign will not share your information with any business other than in the course of securing online advertising and marketing services on your behalf.

2. Advertising Material

Way WeDesign holds the right to place your business information on publisher and search provider websites, like those listed above. If you wish to not have your business information displayed in such a manner, please let us know before further development. You also authorize Way WeDesign to curate content based on materials and details provided by you and gathered by Way WeDesign including copy, size, text, graphics, addresses, phone numbers, URL’s, logos, trade names, trademarks, service marks, endorsements, photographs or likenesses, and videos. Further, you represent that the information and content you provide to Way WeDesign is true, not false and misleading, and that it complies with all applicable laws and regulations.
Additionally, if agreed upon between you and Way WeDesign, you hereby consent to allowing Way WeDesign to contact your customers in order to gain endorsements and reviews of your products and services for publication. The timing of any articles, press releases, and blog postings is very important to the success of a campaign. For this reason, all monthly content will be considered approved one week after it is sent for approval unless requested edits or other communication is received from the client. Each piece should be released consistently at the same time each month.
Domains purchased on your behalf will be released to you within thirty (30) days after service has been terminated.

3. Unacceptable Practices

As WWD strives to offer the very best service, there are certain guidelines and policies that must govern WWD efforts and relationships with its clients. Practices that are in violation of these guidelines and policies are strictly forbidden and may result in the immediate termination of WWD’ services. Such decisions are at the sole discretion of WWD. Unacceptable practices include, but are not limited to:

• Adult or pornographic material including, but not limited to, sexually explicit or suggestive material
• Sexually oriented products or services (e.g., escort services), or other sexually oriented material
• Nudity, including airbrushing (exceptions granted on a case-by-case basis if for medical or artistic purposes)
• Offensive or otherwise distasteful material
• Content or language that is harmful to minors in any way
• Distribution of internet viruses or other harmful or destructive activities
• Hacking and cracking
• Scams or phishing for personal information
• Illegal gambling, gaming, lotteries, and activities harmful, threatening, violent, abusive, harassing, tortuous, vulgar, obscene, invasive of another’s privacy, racial, ethnically offensive, complaint websites, or otherwise objectionable content or language
• Defamatory, hateful or revenge content or language
• Piracy, and all unauthorized use of materials or content that infringes on third parties’ intellectual properties
• Reselling of any WWD services including, but not limited to, design services, updates, and WTD to third parties without a written re-seller agreement.
• Other activities, whether lawful or unlawful, that WWD deems to be in poor taste or that reflect adversely on WWD or WWD’ other clients

6. Term

The Way WeDesign Contract specifies the initial term for which program rates will be guaranteed, and will be for no less than twelve (12) months for custom programs. All agreements are auto-renewing at the then published service rates. After the initial agreement period, either party may cancel the program with a 30-day written notice to the other party.

7. Representations and Warranties; License and Grant of Rights

You represent and warrant that you have the right to share content that belongs solely to you in marketing ads on your website. You also warrant that this content will not infringe upon the rights of any other parties, nor does it violate any local, state, or federal laws

8. Compensation

You agree that neither you nor Way WeDesign will commit any acts amounting to copyright violation including, but not limited to: a) taking content owned by another individual or organization without permission and sharing it as your own; b) Violation of any copyright, trade secret, patent, proprietary information or nondisclosure rights of third party. You understand that if anyone including yourself commits these acts, Way WeDesign will not be in breach of its contractual obligations and thereby should not be liable for damages.

9. No Guarantees

You acknowledge that Way WeDesign makes no specific guarantee regarding the search providers and publishers to which it submits advertising on your behalf. Therefore, we do not guarantee that your ad will be placed in a particular position or location on any given search engine results page, nor can we guarantee how many people will view your ad, find it helpful, or click through to your site as a result of your ad being shown. Way WeDesign does not warrant that the performance will be error-free but will immediately act to correct errors once they have been identified.

10. Force Majeure

Neither you nor Way WeDesign will be in breach of its obligations under these Terms and Conditions of Service (other than obligation to pay monies due) in the event that, for cause(s) beyond reasonable control, each party is unable to perform, in whole or in part, any one or more of its obligations. Such causes will include, but not be limited to governmental regulation, fire or other causality, inability to obtain materials or services, technical failure or difficulties, problems or interruptions of the internet, or any other cause not within the reasonable control of either party.

11. Assignment

Way WeDesign may assign, delegate or subcontract any rights or obligations under this Terms and Conditions of Service.

12. Miscellaneous

This Terms and Conditions of Service represent the parties’ entire agreement with regard to Way WeDesign’ provision of services. Agreement with these terms and conditions is upon signature of Way WeDesign’s Contract, and it will be binding upon you and your successors.

13. Effective Upon Execution

Terms and Conditions are binding on both parties on the date the Statement of Work is signed and/or payment is made.
